According to TMZ.com, Lawrence Taylor’s legal defense will include claiming he did not have sexual intercourse with the under-aged victim. Instead, TMZ reports, he will claim he masturbated with her present in the room.

As one source put it, Lawrence engaged in a “masturbatory act” and that was it.
According to New York law, “A person is guilty of rape in the third degree when ... he or she engages in sexual intercourse with another person less than seventeen years old.”
This defense is important because oral sex would be included under the “sexual intercourse” label. The story up until now was that the two had engaged in some sort sexual act -- either intercourse or oral sex.
Another issue here would be why the condom that police reportedly found was in the room. TMZ reports LT’s defense to that will be that it’s not his and he didn’t use it -- that’s something a DNA test could prove.
LT’s lawyer has said from the start that his client did not have sexual intercourse with the alleged victim.
