Alex Rodriguez and his lawyers have fashioned their case to the MLB around Rodriguez believing the supplements he took from the Biogenesis lab were legal, reports the New York Daily News.

The Yankees third baseman’s claim is that he went to Biogenesis and founder Anthony Bosch seeking to obtain substances that would have been legal under MLB rules. However, he was unknowingly fooled into taking illegal performance enhancing drugs.
There may be a tiny window of opportunity for Rodriguez. He never actually tested positive for an illegal substance but is connected to Biogenesis through a paper trail and a connection with Bosch. However, MLB reportedly has a large cache of evidence including phone calls, emails and other documents.
Not helping Rodriguez’s case is the fact that Bosch has been fully cooperating with MLB on the Biogenesis case. Bosch has been substantiating evidence against Rodriguez, including the paperwork that first led a Miami newspaper to break the story.
Attorneys for Rodriguez are expected to have a chance to cross-examine Bosch on Wednesday.
Rodriguez is facing a 211-game suspension. He is one of 14 players to be disciplined by baseball for connections to the Biogenesis lab. Milwaukee Brewers outfielder Ryan Braun received a 65-game suspension while the remaining 12 players were all served with the usual 50-game unpaid vacation.
Every player except Rodriguez will be eligible to play in 2014 having served their suspension in full during the 2013 season.
