The woman who lost a civil court case accusing New York Knicks guard Derrick Rose and two of his friends of gang rape has appealed the jury’s decision 24 hours before the end of the 30-day deadline to do so.

Rose’s ex-girlfriend, who was referred to in the lawsuit as “Jane Doe,” claimed that both evidence was excluded and jury instructions were tainted. The Associated Press was the first to report the appeal.
An eight-person jury deliberated for three hours on October 19 before ruling the Knicks star and his friends were “not liable on all counts” of civil complaints that included sexual battery and conspiracy to trespass and commit rape/battery.
One of the jurors who cleared Rose told reporters, “I think most of us believe it’s possible there are pieces of her story that were true, but there just wasn’t any evidence.”
The woman accused Rose and his friends of breaking into her apartment in 2013 and having group sex with her while she was too intoxicated to knowingly give consent. Rose and his friends acknowledged they had sex with the woman, but said she was not unconscious and that consent was given.
On Tuesday, Rose’s team of lawyers sought to recoup $70,000 in legal costs from his ex-girlfriend.
The woman was seeking $21.5 million in her civil lawsuit, and no criminal charges were brought against Rose and his friends. The 28-year-old point guard is set to make $21.3 million over the 2016-17 NBA season.
