With the family of Joe Paterno suing the NCAA to overturn sanctions against Penn State for the Jerry Sandusky scandal, the college athletics governing body has asked a Pennsylvania court to throw out the lawsuit, per Genaro C. Armas of the Associated Press.

“Their suit complains primarily about the conclusions of the Freeh Report, conducted at the behest of the Penn State Board, and the university’s acceptance of its findings,” NCAA chief legal officer Donald Remy said in a statement outlining the organization’s arguments. “The NCAA did not commission the Freeh Report nor had any role in it.”
The Paterno family alleges the NCAA consulted with former FBI director Louis Freeh, who investigated the school in the wake of the scandal, in determining sanctions. Freeh’s investigation determined that there was a massive cover-up of Sandusky’s crimes. The Paternos and some former Penn State officials have denied the cover-up.
The sanctions against Penn State were agreed upon by the NCAA and university president Rodney Erickson in 2012. The Nittany Lions were hit with a four-year bowl ban and a $60 million fine, and the program’s yearly scholarship allotment was reduced from 25 to 15.
