Police conclude Kurt Busch assault investigation, case sent to prosecutors

Prosecutors will review and determine whether charges should be filed against Busch, who is alleged by his ex-girlfriend of assaulting her.

An investigation into allegations that NASCAR driver Kurt Busch assaulted his ex-girlfriend has concluded and been sent to the Kent County (Del.) Attorney General’s Office for determination whether charges should be filed.

Patricia Driscoll accused Busch of grabbing her face and smashing her head against a wall in his motorhome Sept. 26 at Dover International Speedway. The 2004 Cup champion has denied the allegations, but admitted cupping Driscoll’s cheeks and telling her, “You need to leave.”

Driscoll filed a complaint with the Dover Police Department Nov. 5 and the nearly two-month long investigation was completed in late December. The Attorney General’s Office does not have a timetable on when a decision will be made whether to charge Busch. “Their office will review the findings of (the) investigation and make a decision whether Mr. Busch will be charged or not,” the office said in a statement.

During a protective hearing last month, Driscoll said she showed up unannounced at Busch’s motorhome because she was fearful of his safety after a series of text messages she received. Busch testified he was sleeping when Driscoll arrived, who then demanded Busch explain to her 9-year-old son why he ended their relationship. Busch said he repeatedly told Driscoll to leave, who ignored the request.

Busch also called the allegations he smashed Driscoll’s head against a wall a “fabrication,“ while his attorneys have attempted to portray Driscoll as a scorned ex-girlfriend. The hearing resumes Jan. 12.
