The FBI and Internal Revenue Service are investigating Patricia Driscoll, Kurt Busch’s ex-girlfriend, regarding allegations she misappropriated money from a charitable foundation, according to an ESPN “Outside the Lines” investigation.

Among the allegations, Driscoll used Armed Forces Foundation funds to pay for personnel expenditures including legal fees for a child-custody case involving her young son, vacations to Paris and Morocco, in addition to paying off her own credit card bill as well as expenses accrued by Frontline Defense Systems, Driscoll’s private security company.

FBI and IRS are also investigating discrepancies between federal tax filings and audits “totaling in the hundreds of thousands of dollars,” according to the ESPN report. Driscoll is the AFF executive director, a role she’s held for the past 12 years

The report is the second ESPN investigation of Driscoll within the past four weeks. She denied any comment through a spokesperson. The AFF refuted ESPN’s original report in a statement to SB Nation last month.

Driscoll is the former of girlfriend of Busch, who she alleges grabbed her by the throat and smashed her head three times against wall during an incident inside Busch’s motor home Sept. 26 at Dover International Speedway.

A Delaware Family Court granted Driscoll a no-contact order in February against Busch, who during testimony admitted to cupping Driscoll’s face, but not assaulting her. In his ruling, Commissioner David Jones stated Busch “more likely than not” assaulted Driscoll, who he had broken up with the week before.

NASCAR suspended Busch indefinitely upon Jones releasing his summation. The 2004 Cup Series champion returned in March after missing three races, a week after the Delaware Attorney General’s office declined to pursue criminal charges.
