Stewart is not under investigation for any criminal wrongdoing pertaining to the incident involving a heckler Friday night at the Chili Bowl Nationals.

Kyle Hess has been an employee of the Tulsa County Sheriff’s Office for “at least 20 years” and works in the criminal investigation division, Green said. Because of Hess’ involvement, an investigation is ongoing to determine if he acted inappropriately. That investigation is expected to conclude sometime next week.
Neither the Sheriff’s Office nor the Tulsa Police Dept. is investigating Stewart for his role in the incident.
Hess was attending the Chili Bowl, an indoor Midget race at the River Spirit Expo Center, and according to multiple witnesses he had been repeatedly making obscene gestures towards Stewart, who was not racing but in attendance helping with track preparations.
Stewart walked up into the grandstands to confront Hess and as he did so appeared to place his hands on Hess’ shoulders. A verbal exchange ensued with Hess telling Stewart, “I don’t like you and I never have.” A brief scrum then followed, with Hess lunging at Stewart before a security guard appeared to shove Hess, who fell to the ground.
Multiple videos captured the incident.
