No Charges Will Be Filed Against Dezmine Wells

Ex-Xavier Musketeers guard Dezmine Wells will have no criminal charges filed against him, according to Cincinnati.com.

Back on Aug. 21, Wells was expelled from the university due to a “serious violation of the Code of Student Conduct.”

However after carefully reviewing the case that alleged Wells committing sexual assault, Hamilton County Prosecutor Joseph T. Deters dismissed the allegations.

”We always take allegations of this nature very seriously. I assigned senior assistant prosecutors to this case to review all of the evidence and to conduct a complete presentation to the Hamilton County Grand Jury.

After this office conducted an independent review of all of the evidence, it was presented to a Grand Jury yesterday. The Grand Jury declined to charge Dezmine Wells with any criminal offense.

I have nothing but the greatest respect for Xavier University, and in particular Fr. Graham. I would sincerely hope the institution would revisit this situation.”

Deters went on to say Wells shouldn’t have been put in the situation that determined his academic and athletic fate.

“There is something flawed with a procedure where a young man and his accuser appear before a group of people, which I would suggest probably isn’t well trained in assessing thse types of cases, and they sit there and tell their stories. No lawyers, no nothing. There’s just something wrong with that,” Deters said.

When asked if Wells would ever want to return even if allowed, his attorney Merlyn Shiverdecker expressed some doubt.

“He is conflicted. He loved his teammates. He loved his coaches. He loved Xavier University. But to suggest right now that he would be 100 percent committed to coming back, I couldn’t say that. He’s very disappointed and hurt about the nature of allegations against him and the fact that this ever happened.”
