Ahmad Brooks could be facing assault charges

The 49ers defensive standout might have legal issues ahead of him.

San Francisco 49ers linebacker Ahmad Brooks is waiting to find out whether he is facing charges in connection with the alleged assault of teammate Lamar Divens, a reserve nose tackle, according to the Mercury News.

A prosecutor in the Santa Clara County District Attorney’s Office submitted an arrest warrant application on June 27, charging Brooks with felony assault. A judge signed off on the warrant, but higher level officials in the DA’s office intervened.

A day later, after the judge signed the warrant, higher ranking officials in the DA’s office took the rare step of intervening and notified the court at 4:30 p.m. Friday to hold it, a court spokesman said. Sources said some members of [District Attorney Jeff] Rosen’s administration view the case as a wobbler -- meaning it could be pursued as a misdemeanor instead of a felony -- and others want to drop it entirely.

According to police, Divens claims that Brooks struck him in the head with a beer bottle three times before punching him in the face during an argument outside Brooks’ home. Divens needed three stitches.

Brooks has been in trouble off the field before. In 2008 while a member of the Cincinnati Bengals, a woman claimed Brooks punched her in the face.

The 29-year-old signed a six-year, $44.5 million deal with the 49ers last season, so it would be tough for San Francisco to jettison Brooks if they wanted to should the allegations prove true.
