San Francisco 49ers fullback Bruce Miller has been charged with misdemeanor vandalism, according to a news release from the Santa Clara District Attorney's office, via Cam Inman of the San Jose Mercury News. Miller is scheduled to be arraigned on the charge on Monday, and if convicted could face up to a year in jail.

The 49ers’ starting fullback will be arraigned on the charge on Monday.


Miller was originally arrested in early March on what was then called a spousal battery charge, stemming from an incident with his girlfriend. At the time, it was reported that Miller and his girlfriend got into an argument and that she was pushed. During the argument, Miller also reportedly threw her phone at the wall.
According to the release, Miller is being charged for throwing the phone at the wall as reported, but results into the alleged assault were “inconclusive.” The woman originally told police that Miller had “pushed her out of the vehicle” before smashing her phone, but the report states she did not sustain any visible injuries or have complaint of pain, and that she denied any physical contact in a later interview.
There was an independent witness at the scene who saw Miller throw the phone at the wall, but there is no indication that anybody witnessed any assault. “Even relatively minor domestic violence incidents can be the first steps on a path that ends in tragedy. That’s why we take all domestic violence cases seriously,” said Jim Demertzis, who supervises the District Attorney’s Family Violent Unit.
The 49ers have issued a statement from general manager Trent Baalke saying that the team is “aware” of the developments on Monday and that it will “continue to monitor these legal proceedings closely.” Miller is not currently participating in the 49ers’ voluntary offseason program due to the ongoing investigation.
