Aldon Smith rejoins 49ers off non-football injury list

Aldon Smith is back with the 49ers after spending more than a month on the non-football injury list following a spate of off-field problems, including a DUI arrest and felony weapons charges.

Aldon Smith is back on the San Francisco 49ers roster. The team announced Thursday that the outside linebacker has been activated from the non-football injury list after he took after an extended voluntary leave of absence to deal with off-field issues. Smith will be eligible to play for the 49ers following the team's Week 9 bye, assuming he doesn't receive a suspension from the NFL.

On the field, Smith’s 2013 season got off to an excellent start. He had 4.5 sacks through the 49ers’ first three games.

Off the field was another matter. Smith was arrested for driving under the influence after wrecking his car on a tree in a single-vehicle accident in September. He stepped away from the team voluntarily and checked himself into rehab after police found marijuana and pills inside Smith’s vehicle. While Smith was in rehab, he was charged with felony weapons possession. He turned himself in on the gun charges Wednesday.

The league has yet to take any disciplinary action against Smith. If Roger Goodell doesn't respond, Smith is expected to suit up when the 49ers play the Carolina Panthers on Nov. 10.
