Aldon Smith arrest: 49ers LB turns himself in on gun charges

Aldon Smith surrendered to authorities on felony weapons charges Tuesday. The 49ers outside linebacker is currently serving out a voluntary indefinite leave of absence following his DUI arrest in September.

Aldon Smith has turned himself in to authorities on felony weapons charges, NBC Bay Area reports. The San Francisco 49ers linebacker reportedly surrendered Tuesday evening and immediately posted $75,000 bail. Smith was charged with possessing illegal assault weapons on Oct. 9 while he was in rehab as result of his DUI arrest in September.

According to David Fucillo at 49ers blog Niners Nation, the latest on Smith could mean that the outside linebacker is out of rehab:

There were reports he would meet with the team during the bye week, at which point the next step would be assessed. There have been no reports of a meeting, but I suspect something will go down in the next few days before the team reconvenes next week in their preparations for the Carolina Panthers.

Smith is currently taking a voluntary indefinite leave of absence from the 49ers to allow himself time to sort out his issues. Recent reports indicate that the organization does not expect the uber-talented pass rusher to return this season. Smith appeared in the Niners’ first three games of the season and recorded 4.5 sacks.

The weapons charges stem from a 2012 house party gone bad at Smith’s residence in San Jose. Smith and two guests were stabbed and police later found a cache of assault rifles and ammunition. The weapons were purchased legally in Arizona, but were not modified to comply with California’s stricter gun laws.

Smith’s surrender was reportedly part of an agreement with Santa Clara County District Attorney Jeff Rosen. Smith is scheduled to face the weapons charges in court on Nov. 12. He will face his misdemeanor DUI and drug charges on Nov. 19.
