NASCAR CEO Brian France has been arrested in The Hamptons for driving under the influence and possession of a controlled substance, according to a report from TMZ.

France was driving in the exclusive New York beachside community of Sag Harbor on Sunday night when he drove through a stop sign and was pulled over by police. According to the report France failed a roadside field sobriety test, and when tested he measured at twice the legal limit. In addition, officers found Oxycodone pills in his car while searching it following the stop.

Oxycodone is on NASCAR’s list of banned substances which drivers are tested for regularly. In May driver Spencer Gallagher was issued an indefinite suspension by the sport for failing a substance abuse test. NASCAR said it would require Gallagher to pass through a substance abuse program before it would review the possibility of him returning to the track.

While the NASCAR substance abuse policy states that it applies to everyone in the sport, it’s unclear whether it would apply to France as CEO.

At the time of writing there has been no official statement by NASCAR regarding the alleged arrest of France.
