Kurt Busch remains suspended

Kurt Busch will remain indefinitely suspended despite not facing criminal charges for allegedly assaulting his ex-girlfriend.

Despite not being criminally charged of assaulting his ex-girlfriend, Kurt Busch’s indefinite suspension continues, NASCAR announced Thursday afternoon.

“NASCAR is aware of the Delaware Department of Justice announcement today regarding driver Kurt Busch,” the sanctioning body said in a statement. “As we disclosed Monday, he has accepted the terms and conditions of a reinstatement program and is actively participating in the program. Kurt Busch’s eligibility for reinstatement will continue to be governed by that program and the NASCAR Rule Book, though the elimination of the possibility of criminal charges certainly removes a significant impediment to his reinstatement.”

The decision follows the Delaware Attorney General’s office declining Thursday morning to charge Busch for assaulting a former girlfriend in an incident that occurred inside his motor home Sept. 26 at Dover International Speedway. Busch is alleged to have grabbed Patricia Driscoll by the throat and smashed her head three times against the wall.

Driscoll was granted an order of protection by a Delaware Family Court Feb. 16 with the commissioner’s findings released Feb. 20, which stated Busch “more likely than not committed an act of abuse” against Driscoll.

Shortly after the details of the no-contact hearing were revealed, NASCAR suspended Busch indefinitely. He missed the Daytona 500 two days later and the subsequent race March 1 at Atlanta Motor Speedway.
