Denver Broncos cornerback Perrish Cox entered a not guilty plea on charges of sexual assault back in May and will go to trial later this year in October. However, a side battle is taking place before the trial begins. The Denver Post and the Associated Press have been trying for months to have Cox's arrest affidavit unsealed, all to no avail.
Broncos’ Perrish Cox Has Arrest Afffidavit Release Delayed In Sexual Assault Case
That is, until recently. A redacted version of the affidavit was set to be released on Friday, but District Judge Paul King delayed the release on Wednesday, reports the Denver Post. Now Cox’s defense attorney will appeal to the Colorado Supreme Court. No one is sure when a ruling would come, but July 14 is the first day it could happen. It could take significantly longer.
None of the attorneys in this case have asked for the release of the affidavit, believing the information could prejudice the jury against Cox or the alleged victim. The trial is set to take place on Oct. 18. If found guilty, Cox could face charges of up to life in prison.
